Terms and Conditions of Business
It is mutually agreed that the following terms form an integral part of this contract and that no variation shall be effective unless accepted by J Graham (Village Photography) in writing.
The booking fee secures the services of Village Photography for the wedding and is Non-Refundable or transferable in the event of cancellation. The booking fee of £100 is required when the client signs this contract. Dates are only reserved when the booking fee is paid. If an album is ordered at the time of booking payment for the album is required to cover cost to purchase and store to ensure price. This sum will apply towards the contracted fee.
Any cancellation less than 12 weeks before the
wedding will result in payment in full as due. All cancellations must be in
writing Weddings that are postponed to a later date will
retain the booking fee as long as Village Photography can re-schedule for the
new date. All price increases that take place prior to the new date will be
added to the contracted cost.
To make the best use of available surrounds and
shade in setting up the groups and individuals in order to provide the best
images possible due to circumstances and weather conditions. (Examples rain,
bright sunlight, snow, wind ect,ect)
Pre-wedding visits, time before, during and after service, editing images, providing proofs for approval to allow client to chose required images for chosen package. Services provided make up the majority of the package cost chosen by the client. In accepting the terms and conditions set out within this contract you are in agreement that you accept that the photographer (Village Photography) will make a judgement call on the day to the best of his or her ability and knowledge.
Weather permitting the photographs will be taken as
agreed. In the event of inclement weather the photographer in co-operation with
the client will make the necessary changes to the schedule and will do his best
to produce coverage of the wedding within the time allocated to him. The
photographer (Village Photography) may if he or she feels it necessary too ask
any other person or persons that are taking photos to refrain from taking
photos if they feel that they are causing delays or affecting the images that
he or she are taking. Similarly, when
delays occur due to circumstances outside his control, the photographer will
stay on beyond the agreed time but will charge an additional fee for the extra
time involved.
In
the unlikely event of total photographic failure, Act of God, extreme weather
conditions, or any unforeseen circumstances beyond the control of either party
the liability shall be limited to the value of the main photographic package
cost only, booking fee and extras
not included. Neither party shall be liable for indirect or consequential loss.
( The photographer ) cannot be held responsible for the lack of coverage caused by the bride, bridegroom, or other members of the wedding party not being on time, nor by restrictions placed on the photographer by officials of the church, register office or licensed marriage venues. The photographer has the right to move on to the next pose and not have to wait for guest’s taking photos. The photographer can at any time ask any guest to refrain from taking photos if he feels they are delaying him from taking photos’ in the time allowed. A time of at least 1hr 30 mins must be allowed after service. The photographer does not guarantee any specific picture nor to include any specific background, location, props or arrangement although every effort will be made to interpret the client’s wishes.
COLOUR MATCHING and SIZES
The dyes used for clothing, particularly man made
fibres do not always photograph in the manner in which they appear to the eyes.
When the photographs are printed to produce a pleasing flesh colour such
materials may appear incorrect. J Graham (Village Photography) will endeavour
with the guidance of the processing labs to achieve the closet possible match
within the limitations of materials and processes used. All quoted sizes are
nominal and may be subject to a slight margin of error. J Graham
(Village Photography) accepts no liability for such minor variations in size.
The copyright in all photography created by the
photographer (Village Photography) shall remain the property of the
photographer (Village Photography) in accordance with the copyright, Designs
and Patents Act 1988.The photographer (Village Photography) may use any
image that is copyrighted to (Village Photography) as promotional material for
display, Internet, banners, posters, leaflets and any advertising in the
promoting of (Village Photography) for wedding photography. The client’s shall
have no right to reproduce, nor to authorise the reproduction of, by any means
whatsoever, any photographs created by (Village Photography). This includes
photocopying, scanning into a computer, photography with a film or electronic
camera, including a video camera, and producing either a hard copy on paper,
film or similar medium, also recording an electronic image on a computer hard
disk, or any tape, disk or any other type of recording medium, digital flash
cards, memory sticks. Nor is it
permitted to transmit or allow be transmitted such images by cable, radio waves
or the Internet. The client hereby acknowledges that infringement of (Village Photography’s) copyright is unlawful
and may be a criminal offence.
IMAGE FILES
Image files taken on the day will be viewed and
reduced by (Village Photography) to provide an unspecified amount for proofed
images. These image files created by J Graham
(Village Photography) shall remain the property of J Graham (Village
Photography) who undertakes to store such image files, for a maximum period of
12 months safely and make them available for future reproduction by (Village
Photography). Photographic prints will become and remain the property of the
Client (S). However the Client (S) specifically acknowledge that ownership does
not imply ownership of the copyright images on them, or any right to reproduce,
or authorise the reproduction, of such images.
PROOFED PREVIEWS
Proofed previews will be provided on a VCD or in a
Printed format but may be an extra charge (subject to change without prior
notice) approximately 5 to 6 weeks after the date of your wedding
( subject to change during busy periods ), these
previews must be returned to J Graham
(Village Photography) within Four weeks so that your wedding prints can be
completed. Once (Village Photography) is in receipt of package order, and has
completed the editing requirements (sizing, colour converting) the expected
time before delivery of order will be within five to six weeks,
digital art work may take longer, (subject to
change during busy periods). The placing of the order for the selected images
for the package chosen by the client is an act of accepting the images of a
standard to meet the client’s requirements. Any complaints should be first
raised by the client with Village Photography in writing within 14 days from
date of receipt of images. No proofed images will be provided for the
night time event, finished prints will be included in final order.
In the unlikely event of Village Photography being unable to attend the wedding I reserve the right to appoint another photographer to attend the wedding on behalf of Village Photography.
